We recognize that the homeowner whose mortgage is in default has been subjected to fraud, deception and unfair dealing by home equity "cowboy". Further, the recent escalation of home values, particularly in the urban areas has resulted in a significant increase in home equities which are usually the greatest financial asset held by the homeowners in this state.

Unfortunately, the financially unsophisticated are vulnerable to the equity purchasers who induced homeowners to sell their homes for a fraction of the fair market value through the use of schemes which often involve oral and written misrepresentations, deceit and intimidation.

It is our express mission to help the homeowner preserve and guard his most precious asset-his home, and for him to maintain his social dignity.It is our goal to promote public welfare.

Our policy is to:

  1. Provide each homeowner with information to make an informed decision regarding the sale of his or her home to an equity purchaser.
  2. Require that the sales agreement be clearly and completely expressed in writing.
  3. Insure, foster and encourage fair dealing in the sale and purchase of homes in foreclosure.
  4. Safeguard the public against recent and financial hardships.
  5. Prohibit misrepresentations that tend to be misleading.
  6. Prohibit or restrain contract terms.
  7. Afford homeowners a reasonable and meaningful opportunity to rescind the equity purchase.
